Our current sick day allowance is the result of the OSSTF Memorandum of Understanding of April 2013, which amended our 2008-12 TBU and OTBU collective agreements for 2012-14. (No modified certification bodies were issued because there was no agreement with the DSBN as to what these changes would mean.) Members of the Teacher Bargaining Unit now have access each year to 11 sick days at 100% salary and 120 sick days at 90% salary. (During LTO use, OTBU members are entitled to 11 sick days/year for 100% and 60 sick days/year for 90%, prorated to the duration of use.) There is an exception when an absence of illness due to the same illness extends to the end of a school year and access lasts only every 120 days, for 90% from the old school year to the new year. If the member can then return to work during the new school year at any time, the member receives a new quota of 11 + 120 days. Every 90% sick days can be increased to 100% salary over 10 days for each of the 11,100% unused days from the previous school year, for example. B 5 unused sick days of 100% in 2013-14 would increase 50 sick days to 90% to 100% in 2014-15. The declaration of absence is governed by another DSBN procedure (AP 5-28) and by Articles 18.18 and 12.04 of the TBU 2008-12 collective agreement, which remain in force: in the spring of 2017, a two-year extension agreement was ratified by the central parties and the OSSTF constitution required ratification of membership. The ratification vote was successful in approving the extension agreement and thus changing the central conditions for the 2017-2019 school years. The extension agreement notably created the Employee Life and Health Trust (ELHT). The OSSTF ELHT is called OSSTFBenefits. The DSBN`s human resources department also identifies patterns of absence taken in the vicinity of vacations or leaves for other purposes, and the attendance management program assigns responsibility for follow-up to the school administration. Thus, disease patterns may lead to a larger examination on Monday or Friday or, due to illness, the days before or after long weekends or days of family care, or Days or Black Friday, and trigger the collective clause (12.04 (b), as above, according to which a member of the OSSTF-TBU has a medical certificate for an absence of less than five days.

Sometimes, on those days, a school administrator will speak to a sick OSSTF member at home to exercise discretion with respect to 12.04(b). So if you answer the phone, you`re less likely to be asked for a medical certificate than if you let it ring. While this obvious lack of confidence in the professionalism of OSSTF members is regrettable, it can fall within the confines of labour law. OSSTF District 22 TBU has in the past bereaved some DSBN practices with respect to sick leave and medical certificates, but the ability to do so successfully in a given situation depends on the particular facts of the case. The right of TBU members to use the 11 + 120 days of sickness is based on the language of collective agreement 2008-12, Article 12.01 (b): “A worker has the right to receive his sickness benefits. for personal medical absences which must include illness, injury, medical diagnosis, treatment and consultation. Due to current practice, the dentist is included in “medical”. . . .
